Trademark Policy
FJH GLOBALCONSULT TRADEMARK USAGE POLICY

FJH Globalconsult ("FJH") has invested significant time and resources to protect its trademarks, service marks, and logos. Trademarks are important for establishing and protecting corporate brand identity but they are fragile rights that can be lost through misuse.

These Trademark Usage and Guidelines ("Policy") set forth the authorized legal policies for using or referring to FJH brands, trademarks, service marks, logos and slogans. This Policy does not otherwise grant you (if you are a non-FJH third party) the legal right to use FJH or other third party trademarks apart from the rights already granted pursuant to a separate agreement with FJH. This Policy should be read in conjunction with the trademark provisions contained in your agreement with FJH.

FJH's Trademark Guidelines (set forth below) will provide you with the specific tools needed to apply FJH's marks consistently under this Policy.

A. General Principles


What are Trademarks and Service Marks?
Trademarks and service marks are words, acronyms, logos, symbols, taglines, or slogans that identify and distinguish a company as the source of its products and services. The owner of a valid trademark may prevent others from using its mark for particular goods or services, and may recover monetary damages caused by another's infringement. Trademarks and service marks can be classified in two categories:
  •  Registered marks (indicated by the ® symbol) have undergone the appropriate legal process and are registered with ie the U.S. Trademark Office. Marks also may be registered in individual states and foreign countries.
  •  Common law (unregistered or pending applications) marks (indicated by the ® or "SM" symbol) have not been formally registered, but may still be valid and enforceable (although registration provides additional legal rights).

B. General Rules of the Road


Subject to the terms of this Policy, you should observe the following general principles in connection with the use of FJH's trademarks:
  •  Maintain the Integrity of FJH's Marks. The use of FJH's marks must not disparage FJH, its marks, products or services.

  •  Apply the Trademark Guidelines. Refer to the Trademark Guidelines, which are a part of this Policy, for the specific tools, examples and guidelines needed to use FJH's marks properly. The Trademark Guidelines provide detailed information on the appropriate communication and display of FJH's marks, including their prominence by size, typeface, color, and style for general use, and use in product packaging and labeling, advertising, marketing and promotional material, and software products designed for use with FJH's products and services.

  •  Apply the Trademark and Service Mark Symbols Correctly. Always use the registered trademark/service mark symbol "®" when referring to FJH's registered marks (e.g., FJH®). Use the unregistered trademark symbol "®" when referring to FJH's unregistered trademarks and the unregistered service mark symbol "SM" when referring to FJH's unregistered service marks You must use the proper symbol with each of FJH's marks, and apply the symbols consistent with the examples in the Trademark Guidelines, in every copy of the communication, document, packaging or other material in which FJH's mark appear, regardless of the medium. An updated list of FJH's registered and unregistered marks may be found in the Trademark Guidelines.

  •  Link FJH's Marks with FJH. Always provide the following notice at least once within each copy of the communication, document, packaging or other material referencing any FJH mark: "[Identify mark(s) used] [is a trademark or registered trademark/are trademarks or registered trademarks] of FJH Globalconsult in Germany and other countries."

  •  Keep FJH's Marks Separate and Distinct. FJH's marks must be used separately from any other organization's logos, trademarks or service marks, and may not be used as part of the name for any other organization or its products or services. Your company's mark can be used in context with a FJH mark solely to indicate a relationship between FJH products and services and those of the other company (e.g., [Third Party Company's] services are Powered by FJH®"). You may not abbreviate or vary the spelling of FJH's marks or use any product names or marks confusingly similar to FJH's marks.
